Short answer: A PPWR manufacturer is responsible for packaging conformity; an EPR producer is responsible in a Member State for registration, reporting and financing; an importer places packaging from a third country on the Union market. One company may be all three, but not automatically.
Manufacturer
The manufacturer makes packaging, or has it designed or manufactured, and markets it under its name or trademark. Article 15 assigns the conformity assessment, technical documentation, EU Declaration of Conformity, traceability and corrective-action duties to that role.
Producer
The Article 3 producer definition determines who carries EPR in a Member State. The analysis depends on establishment, packaging category, first making available in the territory and, for some cross-border supplies, the location of the end user. Articles 44 and 45 connect the role to registration, reporting and EPR financing.
Importer
An importer is established in the Union and places packaging from a third country on the Union market. Article 18 requires checks before placing the packaging on the market, including manufacturer identification, conformity assessment, documentation and relevant marking or information.
Why the distinction changes the file
The manufacturer owns the conformity conclusion. The importer verifies and retains access to it. The producer registers and finances waste-management responsibility in the relevant Member State. Calling every role “the supplier” or “the producer” hides the actual tasks.
Practical role map
- Map each legal entity, transaction and market route.
- Identify whose name or trademark is used and who commissioned the packaging.
- Identify the entity importing from outside the Union.
- For every Member State, identify who first makes the packaging available or supplies the end user.
- Assign conformity, verification and EPR tasks separately.
- Record the legal basis and exceptions.
